Please consider my opinion in your review of Florida statute 563.06(6), the malt beverage container size restriction.

The beer bottle size law in Florida needs to be amended. Restrictions on beer bottle sizes sold in this state seriously limit consumer choice. The influence and interests of any brewer, distributor and/or importer within or outside of the state of Florida should not impede a free marketplace within Florida nor the ability of Floridians to have a choice of a vast selection of products from around the country and the world. Concerns about restrictions on commodity trade between businesses of the United States and foreign businesses and countries should be addressed at the federal level, not the state level. Why should the citizens and tourists of Florida be held hostage by a select few US companies claiming that some European companies and countries don't play fair. Once again, trade concerns at the international level should be addressed by the federal government, not the state of Florida.

The restrictions of 563.06(6) limit competition. A brewer, wholesaler, retailer or bar owner in the state of Florida who wishes to serve a niche market of beer consumers who prefer the flavor of beers in bottle sizes other than 8, 12, 16 or 32oz. can not do so in the state of Florida. The restrictions amount to protecting some manufacturers, wholesalers and retailers both foreign and domestic, from competition abroad and from competition from many American small businesses. This restriction of competition goes against the fundamental characteristic of American commerce -- the open marketplace, whose competitive nature provides the consumer with the products that s/he desires in the most efficient manner possible. It is my belief that restricting competition does not increase efficiency and benefit the consumer, it does just the opposite.

Please vote to pass House Bill 811 that would amend the current law to allow for any size malt beverage container up to 32 ounces in the state of Florida. Your interest and involvement in this issue is greatly appreciated.
